CrossNet end user licence agreement (EULA)

This agreement
This end user licence agreement ("EULA") is between you and WAGGLOR SOLUTIONS LLC, Sharjah Media City, Sharjah, United Arab Emirates ("we", "us"), the licensor of the CrossNet app ("the app"). It is not an agreement with Apple Inc. or Google LLC. We, not Apple or Google, are responsible for the app and its content. The terms and conditions and the privacy policy also apply.
By tapping "Agree and continue" or by installing or using the app, you accept this EULA. If you do not accept it, do not install or use the app.
Your licence
We give you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use the app on devices that you own or control, for your own non-commercial use, and as the rules of the App Store or Google Play allow.
What you may not do
You may not copy, modify, translate or create works based on the app; rent, lend, sell, sublicense or distribute it; reverse engineer, decompile or try to get at its source code, except where the law allows it despite this restriction; remove or hide any notice in it; get round its security, including its device checks; use bots, scripts or cheats; or use the app in any way that breaks the law.
Updates
We may offer updates, which may change or remove features. Some updates may be needed for the app to keep working. Updates are licensed under this EULA unless they come with their own terms.
Ownership
The app, its puzzles, words, clues, sounds, designs and name belong to us or our licensors. This EULA gives you a licence to use them, not ownership. The app includes third-party and open-source software, which is licensed under its own terms.
Support
We are responsible for support and maintenance of the app. Write to crossnet@wagglorsolutions.com. Apple and Google have no duty to give support for it.
No warranty
The app is provided "as is" and "as available". As far as the law allows, we give no warranty that it will be error-free or uninterrupted. If you downloaded the app from the App Store and it fails to meet a warranty that applies, you may tell Apple, and Apple will refund the price you paid for the app, if any. Apple has no other warranty duty for the app. Any other claim, loss, liability or cost about a failure to meet a warranty is our responsibility.
Claims
We, not Apple or Google, are responsible for dealing with any claim you or anyone else makes about the app or your use of it, including claims about product liability, about not meeting a legal or regulatory requirement, and under consumer protection or similar laws.
If anyone claims that the app or your use of it infringes their intellectual property rights, we, not Apple or Google, are responsible for investigating, defending, settling and discharging that claim.
Our liability
As far as the law allows, we are not liable for indirect or consequential loss, or for lost progress. Nothing in this EULA limits a liability that cannot be limited by law, or the rights you have as a consumer under the law of your country.
Legal compliance and third-party terms
You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
You must also follow the terms of any third-party agreement that applies when you use the app, such as your mobile data plan.
Apple App Store users
This EULA is between you and us only. Apple and its subsidiaries are third-party beneficiaries of this EULA. When you accept it, Apple has the right to enforce it against you as a third-party beneficiary. You may use the app only on Apple devices that you own or control, as the App Store's usage rules allow.
Google Play users
This EULA is between you and us only. Google is not a party to it and has no duty to you in connection with the app.
Ending this agreement
This EULA lasts until it ends. You can end it at any time by deleting the app and your account. It ends automatically if you break it, and we may end it at any time. When it ends, you must stop using the app and delete it.
Governing law
This EULA is governed by the laws of the United Arab Emirates as applied in the Emirate of Sharjah, and disputes go to the courts of Sharjah. This does not take away rights that the law of your country gives you as a consumer.

هذه الاتفاقية
اتفاقية ترخيص المستخدم النهائي هذه («EULA») بينك وبين شركة WAGGLOR SOLUTIONS LLC، مدينة الشارقة للإعلام، الشارقة، الإمارات العربية المتحدة («نحن»)، المرخِّصة لتطبيق CrossNet («التطبيق»). وليست اتفاقًا مع Apple Inc. ولا مع Google LLC. نحن، لا Apple ولا Google، المسؤولون عن التطبيق ومحتواه. وتسري كذلك الشروط والأحكام وسياسة الخصوصية.
بضغطك على «أوافق وأتابع» أو بتثبيت التطبيق أو استخدامه فإنك تقبل هذه الاتفاقية. وإذا لم تقبلها فلا تثبّت التطبيق ولا تستخدمه.
ترخيصك
نمنحك ترخيصًا محدودًا شخصيًا غير حصري وغير قابل للتحويل وقابلًا للإلغاء لتثبيت التطبيق واستخدامه على أجهزة تملكها أو تتحكم بها، لاستخدامك الشخصي غير التجاري، وبالقدر الذي تسمح به قواعد App Store أو Google Play.
ما لا يجوز لك فعله
لا يجوز لك نسخ التطبيق أو تعديله أو ترجمته أو إنشاء أعمال مشتقة منه؛ ولا تأجيره أو إعارته أو بيعه أو ترخيصه من الباطن أو توزيعه؛ ولا الهندسة العكسية أو فك الترجمة أو محاولة الوصول إلى شفرته المصدرية، إلا حيث يسمح القانون بذلك رغم هذا القيد؛ ولا إزالة أي إشعار فيه أو إخفاؤه؛ ولا الالتفاف على حمايته، ومنها فحوصات الجهاز؛ ولا استخدام برامج آلية أو سكربتات أو أدوات غش؛ ولا استخدام التطبيق بأي شكل مخالف للقانون.
التحديثات
قد نقدّم تحديثات، وقد تغيّر ميزات أو تزيلها. وقد يلزم بعضها لاستمرار عمل التطبيق. وتُرخَّص التحديثات بموجب هذه الاتفاقية ما لم تأتِ بشروطها الخاصة.
الملكية
التطبيق وألغازه وكلماته وأسئلته وأصواته وتصاميمه واسمه ملك لنا أو لمرخّصينا. وتمنحك هذه الاتفاقية ترخيصًا باستخدامها لا ملكيتها. ويتضمن التطبيق برمجيات من أطراف ثالثة ومفتوحة المصدر مرخّصة بشروطها الخاصة.
الدعم
نحن المسؤولون عن دعم التطبيق وصيانته. راسلنا على crossnet@wagglorsolutions.com. ولا يقع على Apple ولا Google أي واجب لتقديم الدعم له.
عدم وجود ضمان
يُقدَّم التطبيق «كما هو» و«كما هو متاح». وبالقدر الذي يسمح به القانون لا نضمن خلوّه من الأخطاء أو الانقطاع. وإذا نزّلت التطبيق من App Store وتبيّن أنه لا يستوفي ضمانًا ينطبق عليه، فيمكنك إبلاغ Apple، وستعيد Apple السعر الذي دفعته للتطبيق إن وُجد. وليس على Apple أي التزام ضمان آخر تجاه التطبيق. وأي مطالبة أو خسارة أو مسؤولية أو تكلفة أخرى تتعلق بعدم استيفاء ضمان فهي علينا نحن.
المطالبات
نحن، لا Apple ولا Google، المسؤولون عن معالجة أي مطالبة تقدّمها أنت أو أي شخص آخر بشأن التطبيق أو استخدامك له، ومنها المطالبات المتعلقة بمسؤولية المنتج، وبعدم استيفاء متطلب قانوني أو تنظيمي، وبموجب قوانين حماية المستهلك وما يشبهها.
وإذا ادّعى أي شخص أن التطبيق أو استخدامك له ينتهك حقوق ملكيته الفكرية فنحن، لا Apple ولا Google، المسؤولون عن التحقيق في هذه المطالبة والدفاع عنها وتسويتها والوفاء بها.
مسؤوليتنا
بالقدر الذي يسمح به القانون لا نتحمل مسؤولية الخسائر غير المباشرة أو التبعية، ولا فقدان التقدّم. ولا يحدّ أي شيء في هذه الاتفاقية من مسؤولية لا يجوز تحديدها قانونًا، ولا من حقوقك كمستهلك بموجب قانون بلدك.
الامتثال القانوني وشروط الأطراف الثالثة
تقرّ بأنك لست موجودًا في بلد خاضع لحظر من حكومة الولايات المتحدة أو صنّفته حكومة الولايات المتحدة «بلدًا داعمًا للإرهاب»، وبأنك غير مدرج في أي قائمة لحكومة الولايات المتحدة للأطراف المحظورة أو المقيَّدة.
ويجب عليك أيضًا الالتزام بشروط أي اتفاق لطرف ثالث ينطبق عند استخدامك التطبيق، مثل باقة بيانات هاتفك.
مستخدمو Apple App Store
هذه الاتفاقية بينك وبيننا فقط. وApple وشركاتها التابعة مستفيدون من الغير بموجب هذه الاتفاقية، وعند قبولك لها يحق لـ Apple إنفاذها عليك بصفتها مستفيدًا من الغير. ولا يجوز لك استخدام التطبيق إلا على أجهزة Apple التي تملكها أو تتحكم بها، وفق قواعد الاستخدام في App Store.
مستخدمو Google Play
هذه الاتفاقية بينك وبيننا فقط. وGoogle ليست طرفًا فيها ولا يقع عليها أي واجب تجاهك فيما يخص التطبيق.
إنهاء هذه الاتفاقية
تستمر هذه الاتفاقية حتى تنتهي. ويمكنك إنهاءها في أي وقت بحذف التطبيق وحسابك. وتنتهي تلقائيًا إذا خالفتها، ويحق لنا إنهاؤها في أي وقت. وعند انتهائها يجب أن تتوقف عن استخدام التطبيق وأن تحذفه.
القانون الواجب التطبيق
تخضع هذه الاتفاقية لقوانين دولة الإمارات العربية المتحدة كما تُطبَّق في إمارة الشارقة، وتُحال النزاعات إلى محاكم الشارقة. ولا ينتقص ذلك من الحقوق التي يمنحك إياها قانون بلدك كمستهلك.
